Terms of Service

1. The agreement
These Terms of Service (“Terms”) are a contract between you and Echova. They cover the Echova apps for iOS and Android, the website at echova.app, and the account links inside the app, including Account → Terms. There is one set of Terms for all of those surfaces.
The Privacy Policy at https://echova.app/privacy is part of these Terms. It describes what personal information we collect, how we use it, that we do not sell it, and what happens when you delete your account. If these Terms and the Privacy Policy ever differ about a privacy practice, the Privacy Policy controls for that practice.
By creating an account, signing in, or otherwise using Echova, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Echova.
2. Who we are and the service
Echova (“Echova,” “we,” “us,” or “our”) provides a consumer AI fitness coaching app. Echova is not a medical device and is not a HIPAA-covered health service. It is a fitness coaching product.
The service includes workout programs, check-ins, and coaching responses that adapt from what you tell us. Features can change as the product changes. We do not promise that every feature will remain available, or that the service will be uninterrupted.
Contact: hello@echova.app
3. Eligibility
You must be at least 18 years old to use Echova. By using the service, you confirm that you are 18 or older and able to enter a binding contract.
Echova is not directed at children. If you believe someone under 18 has an account, email hello@echova.app and we will take appropriate steps. Children’s privacy is also described in the Privacy Policy.
4. Accounts
You can sign in with an email address and password. Where the app offers it, you can also use Sign in with Apple.
You are responsible for activity on your account and for keeping your sign-in method secure. Email hello@echova.app if you believe someone else has used your account. Provide information that is accurate, and keep it reasonably current.
You can delete your account in the app. Deletion ends active use of your account data, subject to the short operational window described in the Privacy Policy (Retention and account deletion). We do not sell your personal information.
We may suspend or close an account if we reasonably believe it breaks these Terms, harms someone, or abuses the service — including attempts to disrupt Echova or misuse the coaching features. Where practical, we will tell you and give you a chance to fix the problem, unless we need to act sooner to protect people or the service.
5. Subscriptions and billing
Echova is currently free. You do not need a paid subscription to use the service today.
If we later charge for part of Echova, payments will be processed by Apple through In-App Purchase, as described in the Privacy Policy (Section 2.8). Echova does not receive your full payment card details. Apple handles the charge, cancellation, and refunds under Apple’s terms. You manage or cancel an Apple subscription in your Apple ID subscription settings. We may store the subscription status, tier, and expiry we need to provide what you purchased.
Any price will be shown before you confirm a purchase. A material change to billing will be reflected in an update to these Terms.
6. Acceptable use
You agree not to:
- Break the law while using Echova
- Use someone else’s account, or try to access someone else’s data
- Interfere with, overload, or probe the service except through ordinary use
- Scrape, resell, or reverse engineer the service, except where the law does not allow us to restrict that
- Submit content that is illegal, abusive, or that you do not have the right to share
- Use the coaching features to harm someone, or to try to extract other people’s data, model weights, or hidden instructions
- Present Echova as medical care, or as a product of someone else
We may remove content or limit features that break this section.
7. Health and fitness
Echova provides general fitness coaching. It is not medical advice, diagnosis, or treatment. It is not a medical device. It is not a HIPAA-covered health service.
Talk with a qualified clinician before you start or change exercise, especially if you are pregnant, injured, or managing a health condition. Stop and seek medical care if you feel pain, dizziness, chest discomfort, or other warning signs. You decide whether a workout is appropriate for you, including the loads, movements, and equipment. Exercise has inherent risks, including injury.
8. AI-generated content
Programs, check-in responses, and other coaching text may be generated with AI, including the OpenAI API (the API platform, not the consumer ChatGPT product). What we send, how long it is kept on each side, and how that differs from Echova’s own coaching memory are described in the Privacy Policy. These Terms do not change that policy, including the statements that we do not sell personal information and that account deletion is handled as the policy describes.
AI output can be wrong, incomplete, or a poor fit for your body, equipment, or goals. It can suggest exercises, loads, or schedules you should not follow. Read a suggestion before you use it, and skip anything that does not feel right.
Echova does not guarantee an outcome, including a change in strength, body weight, fitness, injury risk, or how often you train. Results depend on factors outside the service.
9. Intellectual property
Echova, the apps, the website, and our name, text, and design are owned by Echova or our licensors. These Terms do not transfer that ownership to you.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the apps and website for your own fitness coaching, for as long as you follow these Terms.
You keep what you submit, including your profile, check-ins, and messages. You give Echova permission to host and use that information to operate and personalize the service for you, as the Privacy Policy describes. That permission ends when we no longer need the information, including after account deletion, except for the short post-delete window the Privacy Policy describes. We do not take ownership of your content, and we do not sell it.
If you send feedback, for example to hello@echova.app, we may use it to improve Echova without an obligation to you.
10. Third parties
Other companies help us run Echova. Their own terms apply to their services.
Apple
Sign in with Apple, the App Store, and any future In-App Purchase are Apple services. If you download Echova from the App Store, you also agree that:
- These Terms are between you and Echova, not Apple. Apple is not responsible for the app or its content.
- Your license to the iOS app is limited, non-transferable, and only for Apple-branded devices you own or control, under Apple’s usage rules.
- Echova, not Apple, provides maintenance and support, and Echova is responsible for product claims and for intellectual-property claims about the app.
- If a warranty applies and the app fails to meet it, you may notify Apple, and Apple may refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
- You are not located in a country subject to a U.S. government embargo, and you are not on a U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this Apple section and may enforce it.
Claims and questions about Echova still go to hello@echova.app.
Google / Firebase
Google / Firebase provides authentication, the Firestore database, Cloud Messaging, and related operations.
OpenAI
OpenAI provides AI coaching through the OpenAI API. Data details are in the Privacy Policy and are not restated as a different rule here.
The Privacy Policy also names the provider that hosts echova.app. A link or integration is not an endorsement of everything a third party does. We are not responsible for services we do not control.
11. Termination
You may stop using Echova at any time. You may delete your account in the app.
We may suspend or end access if you materially break these Terms, if the law requires it, or if we discontinue the service. If we discontinue Echova, we will give notice where practical.
Sections that should keep working after termination stay in effect. That includes intellectual property, the health and fitness section, AI limitations, disclaimers, limitation of liability, indemnity, governing law and disputes, and the parts of the Privacy Policy that still apply to information we retain.
12. Disclaimers
The service is provided “as is” and “as available.” To the maximum extent the law allows, Echova disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the service will be uninterrupted, error-free, or that coaching output will be accurate or safe for you.
Some places do not allow certain disclaimers. In those places, the disclaimers apply only as far as the law allows. You may have rights these Terms cannot take away.
13. Limitation of liability
To the maximum extent the law allows, Echova is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of these Terms or your use of the service.
Echova’s total liability for a claim arising out of these Terms or the service is limited to the greater of (a) the fees you paid Echova in the 12 months before the claim or (b) USD $100. Fees include amounts you pay for Echova, including amounts paid through Apple In-App Purchase for Echova.
This limit does not apply to liability the law does not allow us to limit, including liability for fraud or for injury caused by gross negligence or willful misconduct where a cap is not allowed. Because the service is currently free, the cap is USD $100 until you have paid fees for Echova.
14. Indemnity
If a third party brings a claim against Echova because you misused the service, broke these Terms, or violated someone else’s rights, you agree to cover the resulting damages and reasonable expenses, including reasonable attorneys’ fees, to the extent the claim was caused by you.
This indemnity is limited to those third-party claims. It does not make you responsible for Echova’s own breach or misconduct. Where practical, we will tell you promptly about a claim we ask you to cover.
15. Governing law and disputes
Michigan law governs these Terms and disputes arising out of them or the service, without regard to conflict-of-law rules that would apply another place’s law. The laws of the United States also apply where they must.
If you have a dispute, email hello@echova.app and describe it. You and Echova will try to resolve it informally. These Terms do not require arbitration, and they do not waive any right to participate in a class action.
The state and federal courts located in Michigan, USA, are the exclusive venue for a dispute that is not resolved by that email, and you and Echova consent to personal jurisdiction there. This does not limit a right to bring an eligible claim in small-claims court.
16. Changes
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top and post the revised Terms at https://echova.app/terms. If a change is material, we may also give notice in the app or by email where appropriate.
If you keep using Echova after the update is posted, you agree to the revised Terms. If you do not agree, stop using Echova and delete your account.
